The research project comprises the introduction, a summary of the legal reality of the implementation of international treaties and conventions on Human Rights is made; on the critical, it focuses on the sovereignty of a state for not implementing the treaties and conventions on Human Rights; objectives, general and specific states; resources are detailed. The theoretical frame work consisting of research background, rationale: Doctrine, Jurisprudence, Legislation and Comparative Law under consideration, referring to different laws becomes, especially the Constitution of the Republic of Ecuador is based. In the methodology, the methods used are determined, the skills involved in the field work, the implementation of surveys citizens Quevedo Canton, Lawyers in free practice and interviews with such results tabulation was made, analysis and data processing. The conclusions and recommendations are made; and the proposal to develop an amenment to art. 5 of the Organic Code of the Judiciary, which hallow justice operators without restriction, apply treaties and International Human Rights Conventions to which Ecuador is a signatory. El presente proyecto de investigación, cuyo tema es: “Los Tratados y Convenios Internacionales de Derechos Humanos y su aplicación en el ámbito de la Constitución del 2008”, está compuesta de siete capítulos, en los cuales se detallan aspectos y conceptos del tema investigado. El proyecto de investigación consta la introducción, se hace una síntesis sobre la realidad jurídica de la aplicación de los Tratados y Convenios Internacionales de Derechos Humanos; en la problematización, se enfoca a la soberanía de un estado por no aplicar los tratados y Convenios Internacionales de Derechos Humanos; se señala los objetivos, generales y específicos; se detallan los recursos. El marco teórico, compuesto de antecedentes de la investigación, fundamentación: Doctrina, Jurisprudencia, Legislación y Derecho Comparado se fundamenta, objeto de estudio, donde se hace referencia a diferentes Leyes, en especial la Constitución de la República del Ecuador. En la metodología, se determinan los métodos utilizados, las técnicas aplicadas en el trabajo de campo, la aplicación de las encuestas a los ciudadanos y ciudadanas del Cantón Quevedo, Abogados del sector público, en libre ejercicio profesional y las entrevistas, con tales resultados se realizó la tabulación, análisis y procesamiento de datos.
