Such power to issue and enforce cautionary measures was always exclusive to judges. However, it is important to identify the points in the proceedings in which ordinary justice can be resorted to in order to request the ruling of cautionary measures without the need to waive the arbitral agreement, making this, therefore, a concurrent power of arbitrators and judges. Furthermore, the various international agreements signed and ratified by Ecuador were reviewed. This has been undertaken with the aim of identifying the existence of vacuums in the legal regulations governing arbitration proceedings and finally making a proposal which, through a reform to the law, strengthens the development of arbitration proceedings and their outcomes Se realizó el estudio de la aplicación de medidas cautelares en procesos de arbitraje en Ecuador, con el objetivo de analizar las ventajas que brinda la Ley de Arbitraje y Mediación, en su artículo 9, unos de los más controversiales, ya que mediante este artículo se atribuye cierto poder imperativo a los árbitros, en virtud, de que éstos pueden dictar y ejecutar medidas cautelares, siempre y cuando las partes actoras, lo hayan acordado en el convenio arbitral. Esta potestad de dictar y ejecutar medidas cautelares fue siempre exclusiva de los jueces. Pero es importante identificar los momentos dentro del proceso, en los cuales se puede acudir a la justicia ordinaria para solicitar el dictamen de medidas cautelares, sin la necesidad de renunciar al convenio arbitral. Convirtiéndose entonces esta, en una facultad concurrente de árbitros y jueces. Adicional a esto se revisaron las diferentes convenciones internacionales suscritas y ratificadas por Ecuador.
